10-Year-Old Watches Calif. Suspect Strangle His Mother |

On Christmas Eve 2003, Santa Ana, Calif, cops say that 10-year-old David was at home in Santa Ana, Calif. with his parents, Miguel Angel Martinez and his common-law wife, Estela Lomell Garibay. While others in the neighborhood were preparing for holiday feasts, wrapping gifts, and getting ready to reunite with family members, police say David saw his parents having an argument.
Cops tell AMW that although Martinez had no previous criminal record, friends and family members claim that Estela had been discussing her relationship problems with them, and confessed that Martinez had become controlling and physically abusive. They say Estela, a mother of four, wanted out of the relationship.
The Christmas Eve argument began early in the morning and escalated through the afternoon, when cops say the dispute turned violent. Police say the couple had taken the fight to the bathroom of the master bedroom, and David knocked on the door, hoping he could put an end to his parents' quarrel. The door remained locked so, police say, the boy exited the residence, ran to the backyard, and broke through the bathroom window. Cops say David found his father kneeling over his mother's strangled, lifeless body.
Cops say a neighbor overheard the argument and called 9-1-1. By the time Santa Ana police arrived, Estela was dead, and Martinez had been picked up by his brother -- Jaime Martinez -- and fled the scene. Authorities believe that Martinez was then taken to Mexico by his father, Manuel Delgado Martinez, where he is likely to be living now.
