  Case Story
Fugitive Father Sought For Daughter's Rape
In 2005, police in Kennewick, Wash. came face to face with a heartbreaking case of abuse when they encountered a 13-year-old girl who had run away from home.  Cops say that she was emotionally scarred and had a difficult time communicating verbally so she used the text on her mobile phone to express herself to authorities.  When they began questioning, they were shocked to see her response -- the girl typed "I have been raped and beaten by my father since I was six." The girl's father, John Garza Diaz, was arrested and charged with rape of child.  Authorities questioned the girl's brother during the investigation and found out that Diaz had installed a dead bolt lock on his bedroom door so that no one could interfere during the harrowing instances of abuse.  Police say the brother recalled hearing his sister shouting "no, daddy, no" through the locked door. The investigation into Diaz' past found two other minors that he had sexually abused, one of whom is his cousin.  However, police were unable to file charges for the other victims due to Washington's statute of limitations. Police say that Diaz had initially decided to fight the rape charges but ultimately accepted a plea.  The judge allowed Diaz' release so that he could conclude some personal matters before his surrender.  Yet, authorities say Diaz utilized this time to pack his things and disappear.  Detectives say that Diaz told family members that he was moving and that the rape charges had been dropped.  He also claimed that was voluntarily leaving his job working at a Washington State Employment Services office. Diaz has previously served time in prison.  His daughter is a ward of the court and in foster care.
