  Case Story
  Miami 1979 Redux?
Roving drug gangs with a thirst for blood. Drive-by shootings in broad daylight that litter the streets with shell casings. A deadly holiday shootout in a crowded mall. No, it's not Miami in the late 1970s, and the Colombian cocaine cartels immortalized in the movie "Scarface." For this modern-day sequel, head about 60 miles north to Palm Beach County, where Haitain and Salvadoran gangs with names like Top 6, MS-13, and San Castle Soldiers are using powerful assault rifles to settle scores in once-quiet communities. Since December 2005, there have been about 20 shootings between the rival gangs. In addition to claiming the lives of two San Castle Soldiers, the wild gunfire killed an innocent bystander, and wounded a two-year-old girl. Most of these gangs are composed of immigrants locked out of the system by will or ill, and those who simply choose to engage with society on their own terms. So they turn to the old black market staples of stealing and dealing -- and they embrace a twisted set of values more appropriate to a medieval barbarian horde than to an enlightened republic of laws.   And on December 24, 2006, they brought their version of justice to the local mall in Boynton Beach.

  Deck The Halls With Blood
It was a South Florida Christmas Eve like any other with 20,000 shoppers cramming into the Boynton Beach Mall in search of last-minute gifts. Berno Charlemond, 23, his girlfriend, and her two toddlers were shopping for sneakers in the Foot Action shoe store. Unfortunately for Charlemond, who was a loyal soldier to the B-Town Boys gang, also in the store were 21-year-old Jesse Cesar, 21-year-old Fregens Daniel, and 21-year-old Wilson Pierre Jr., all members of a rival Haitian street gang, San Castle Soldiers.   With his girlfriend in tow, Charlemond reportedly tried to walk away. But according to eyewitness accounts, the San Castle Soldiers went after him, grabbing him. Daniel came up behind Charlemond, slammed him to the ground, and started punching. As two off-duty cops working security ran to break it up, one of the three attackers pulled a gun. Then, cops say that in front of hundreds of shoppers, the man with the gun unloaded six rounds into Charlemond's chest. Someone came on the mall's public address system and told everyone to leave. People were screaming, pushing to get out of the mall. Those that had witnessed the shooting were in tears. Mothers and their children huddled behind clothes racks and in dressing rooms. Cesar, Daniel, and Pierre took off running. Cops say that whoever had the gun fired three to five shots at the pursuing off-duty cops. Police eventually surrounded the entire mall, leading shoppers and employees outside with their hands in the air. Cops quickly took Daniel into custody. Cesar defied a SWAT team and barricaded himself in a Dillard's department store, but a lone officer caught him when he tried to sneak out with customers. As for Wilson Pierre, he got away.

  Focus In Case Shifts
Police originally fingered Cesar as the trigger man. They charged him with first-degree murder, and Daniel with accessory to murder. But testimony from several witnesses made it clear that the cops had to rule out Cesar and Daniel as shooters. To be sure, they were both involved in the physical altercation with Charlemond, but investigators now say it was definitely Pierre that fired the fatal shot. Police released Cesar from jail on his own recognizance on January 3, 2007. They released Daniel on December 27, 2006. Their arrest charges will remain active until the State Attorney's office conducts a full review of the case. As for Wilson Pierre, he's now wanted for muder. Investigators think that Pierre could be anywhere, though he may still be in South Florida, hiding out with fellow gangbangers.
