Cops: O.C. Dinner Date Becomes Date Rape |

In the middle of the night, a young woman wakes up at a friend's house. Her head is spinning. She's confused. Through a haze, she sees her male friend at the foot of the bed, half naked, and she realizes that her own pants have been removed.
She'd become the victim of date rape.
Police say the horrible scenario played out in Newport Beach, Calif. on September 14, 2003. For the rape survivor, the night began as a fun evening out with friends. She says she went to the apartment of Timothy Marino, where the two planned to have dinner and then go out bar-hopping.
Before they headed out, the victim says, Marino handed her a glass of beer. But she didn't want it, so she poured it out. According to the survivor, Marino then became angry and poured her another glass of beer, insisting that she drink it. "I told him okay, fine, I would drink half of it," she remembers, "and that's all I'm drinking."
Police say that beer was a key part of Marino's plan for the evening. They believe it contained a date rape drug. |

Cops Say He Was Caught On Tape -- By Himself |

The victim says that she and Marino took a cab to the Newport Beach Pier, where they met up with Allen Crocker, a friend of Marino's.
But because the bars in the area all were crowded, they decided to head back to Marino's place. That's when the victim says she began feeling drowsy. By the time they got to the apartment, she was struggling to stay awake. It was a struggle she'd quickly lose.
"I went to Tim's room and sat on a chair," she recalled, "and I fell asleep."
Police say it was the moment Marino and Crocker had waited for. With their victim unconscious and helpless, cops say the two men took turns violently raping her.
And apparently, it was a moment they wanted to remember, because police say that earlier in the day, a video camera had been set up in the bedroom, and Marino and Crocker recorded everything they did that night.
On the tape, says Detective John Hougan of the Newport Beach Police Department, Marino can be seen "playing to the camera. He's giving a thumbs up, he's smiling at the camera."
Police say the camera was still rolling when the victim began to wake up, noticed the camera, and asked Marino what was going on.
"This conversation is recorded, with Tim telling her that the camera was not recording anything, when in fact it was," says Det. Hougan. "The victim is obviously confused. Her speech is slurred. Her movements are slowed."
Those are classic symptoms of someone under the influence of a date rape drug. |

One Suspect Goes Down, The Other Hits The Road |

After she left the apartment, the survivor says, she couldn't remember anything about what had happened that night.
Police say this, too, is typical of people exposed to date rape drugs.
But from her condition, the survivor realized that she had been assaulted, and went to the police.
Cops made an appointment with Marino to come in for questioning, but he never showed up. Instead, police say he called the technology firm where he'd worked as an IT consultant for eleven years and abruptly quit.
His boss says Marino asked him to prepare his last paycheck, telling him: "I've got myself in a situation here where I just can't come back."
Then, Timothy Marino vanished.
But police got a major break when the second suspect, Allen Crocker, turned himself in. They say Crocker had possession of the videotape shot in Marino's apartment.
They say that he believed it might somehow prove his innocence. It was a gamble, and Crocker lost. After viewing the tape, a jury convicted him. He's now serving a 7-year prison term.
Timothy Marino is still on the run. Police believe he may be living in Acapulco, Mexico with an unidentified Hispanic female.
They say he's using a new name, but they don't know what it is, and that he's dyed his hair blond. Police say they also have information that Marino is earning money by operating a pornographic website. |
